Rhode Island Traffic Tribunal Rules of Procedure

§ 8-8.2-2 Jurisdiction. Nothing herein supersedes the powers of the Rhode Island Family Court under the provisions of Chapter 1 of Title 14. (d) A party aggrieved by a final decision of the Appeal Board of the Transportation Tribunal shall have the right to have the order reviewed by a judge of the District Court. Unless otherwise provided in the Rules of Procedure of the District Court, such review shall be placed in the file and shall have the character of an appeal. The District Court shall establish, by its Rules of Procedure, the procedures for reviewing a decision of the Appeal Board of the Transport Tribunal. (c) Notwithstanding any conflicting legislative provision, the Transportation Court shall have the power to hear and determine all civil violations of sections 20-1-12, 20-11-20, 20-16-17, 23-22.5-9, 32-2-4, subparagraphs 21-28-4.01(c)(2)(iii) and 21-28-4.01(c)(2)(iv) and subsection 46-22-19(1) in accordance with sections 42-17.10-1, in accordance with rules and regulations issued by the Chief Magistrate of the Rhode Island Traffic Court. (b) Notwithstanding conflicting legal provisions, the Transport Court shall have concurrent jurisdiction to hear and determine all violations of the regulations, rules and regulations governing public waters, and the speed, management and control of all ships and sizes, in accordance with the rules and regulations issued by the Chief Judge of the Traffic Tribunal. The nature, location and use of all anchorages and berths under the jurisdiction of the cities of North Kingstown, South Kingstown, Portsmouth, Middletown, Narragansett and Tiverton, applied and supervised by the harbourmaster and referred to the Traffic Court, and the terms “traffic offences” and “traffic offences” used in this Chapter include the above-mentioned offences and such offences shall be determined in accordance with the provisions of this Chapter. Nothing herein replaces the powers of the Rhode Island Coastal Administrative Council under the provisions of Chapter 23 of Title 46. (e) Violations of any law, rule, ordinance or regulation referred to in this Section shall be punishable by fines under Articles 31-41.1-4, except for violations of Subsections 21-28-4.01 (c) (2) (iii) and 21-28-4.01 (c) (2) (iv).
