Treaties on mutual legal assistance in criminal matters are bilateral treaties concluded between countries on international cooperation and assistance. The treaty aims to increase the effectiveness of both countries in criminal investigations and prosecutions through cooperation and mutual legal assistance in criminal matters. The Ministry of Home Affairs is India`s central authority for dealing with letters rogatory in criminal matters. The Central Authority transmits and receives all requests for mutual assistance either directly or through diplomatic channels. This ensures that criminals do not evade due process or sabotage it due to a lack of evidence available in different countries. The term “letters rogatory” is derived from the Latin term rogatorius. Letters rogatory are requests for assistance addressed by the Court of Justice of one country to the Court of Justice of another country in the investigation or prosecution of a criminal case. It will enhance India`s effectiveness in combating criminal activities involving Poland. Once in force, the Treaty will contribute to providing better input and insight into the functioning of organised crime and terrorists. These, in turn, can be used to refine policy decisions in the area of internal security. The Cabinet of the Union, chaired by Prime Minister Shri Narendra Modi, approved the Treaty on Mutual Legal Assistance in Criminal Matters between the Government of the Republic of India and the Republic of Poland to enhance the capacity and effectiveness of the two countries in investigating and prosecuting criminal offences, including terrorism-related crimes, through mutual legal assistance.
Legal aid is a mechanism through which countries work together to provide and receive formal assistance in preventing, combating, investigating and prosecuting crime. The treaty aims to increase the effectiveness of both countries in criminal investigations and prosecutions through cooperation and mutual legal assistance in criminal matters. Upon signature and ratification of the Treaty, appropriate notices shall be gazetted in accordance with the relevant provisions of CRC 1973 to implement the provisions of the Treaty in India.
