For possession of two ounces or less, you can be fined up to $2,000, up to 180 days, or a combination of both. Possession of marijuana in amounts greater than two ounces but no more than four ounces can result in fines of up to $4,000 or jail time of up to one year.
Four ounces to five pounds of marijuana in your possession can result in a $10,000 fine and up to two years in jail. If you are caught with five pounds to 50 pounds of marijuana plants in your possession, you face up to 10 years in prison and a fine of up to $10,000. Arrests for more than 50 pounds of marijuana can result in up to 20 years in prison and a fine of up to $10,000. Possession of more than one tonne of marijuana can result in life imprisonment and a fine of up to $50,000. For group one drugs, convictions for producing the following penalties are punishable: Drug production is a serious charge and is considered a felony in the state of Texas.
Penalties for a drug manufacturing conviction are severe and depend largely on the type of drug being manufactured and the amount of drug found in your possession. Texas law classifies controlled substances into four distinct categories that correspond to the potential for abuse and medical use of these drugs. Making less than one gram is a state prison felony punishable by up to two years in state prison and a fine of up to $10,000. Making one to four grams is a second-degree felony and can carry up to 20 years in prison and a maximum fine of $10,000. Manufacturing from four to 200 grams is a first-degree felony punishable by up to 99 years in prison and a fine of up to $10,000. Manufacturing 200 to 400 grams is an increased first-degree crime and can carry 99 years in prison and a fine of up to $100,000. Manufacturing 400 grams or more is also an increased first-degree felony punishable by up to 99 years in prison and a fine of up to $250,000. Penalties for drug manufacture in groups two to four are similar, particularly for large quantities of these controlled substances.
In addition, penalties can be much more severe if the manufacturing took place in a designated drug-free area, if there are previous convictions on your record, or if other manufacturing-related charges are laid.
